Terms of Service

Effective Date: June 4, 2026

1. Acceptance of Terms

By accessing or using EliteCRM ("the Service"), you agree to be bound by these Terms of Service. If you do not agree, please do not use the Service.

2. Description of Service

EliteCRM provides a cloud-based call center CRM platform including predictive dialing, call recording, lead management, analytics, and related features ("the Service").

3. Account Registration

To use the Service, you must:

  • Provide accurate and complete registration information
  • Maintain the security of your account credentials
  • Be at least 18 years old
  • Have authority to bind your organization

4. Subscription and Billing

4.1 Pricing: Fees are as published on our website and may change with 30 days notice.

4.2 Billing Cycle: Monthly or annual subscriptions as selected.

4.3 Payment Methods: PayFast, Stripe, PayPal, or EFT.

4.4 Taxes: VAT (15%) will be added for South African customers.

4.5 Late Payment: Accounts may be suspended after 14 days overdue.

5. POPIA Compliance

You agree to:

  • Obtain proper consent before recording calls
  • Use the Service in compliance with POPIA
  • Not process sensitive personal information without consent
  • Report any data breaches immediately

6. Acceptable Use Policy

You may NOT use the Service for:

  • Illegal activities or fraud
  • Harassment or abusive calls
  • Spamming or unsolicited marketing
  • Violating any South African laws

7. Call Recording Consent

You are solely responsible for obtaining proper consent from all parties before recording calls. EliteCRM provides tools to capture consent but does not assume liability for your compliance.

8. Data Ownership

You retain ownership of all lead and customer data you upload. EliteCRM does not claim ownership of your data.

9. Service Level Agreement (SLA)

We strive for 99.9% uptime. Scheduled maintenance will be notified 48 hours in advance. Emergency maintenance may occur without notice.

10. Termination

Either party may terminate with 30 days written notice. EliteCRM may terminate immediately for violation of these terms. Upon termination, your data will be available for download for 30 days.

11. Limitation of Liability

To the maximum extent permitted by law, EliteCRM's liability is limited to the fees paid in the preceding 12 months. We are not liable for indirect or consequential damages.

12. Governing Law

These Terms are governed by the laws of South Africa. Any disputes shall be resolved in the courts of Johannesburg, South Africa.

13. Changes to Terms

We may update these Terms with 30 days notice via email or website notification. Continued use constitutes acceptance.
